The Arc of California RESOLUTION OF SOLIDARITY 2009
This Resolution is the work of families and friends joined together through The Arc of California working with and on behalf of people with developmental disabilities and their families, standing united and dedicated to protecting the rights of children and adults with developmental disabilities in the State of California.
The Arc of California views its responsibilities and commitments to individuals with developmental disabilities and their families as the primary purpose of the organization. We recognize that the needs of people do not change based on a reduction in financial resources. We are dedicated to honoring our purpose, whether financial times are good or bad.
The Arc of California feels strongly that the continuation and expansion of cuts and freezes in the Purchase of Service and regional center Operations budgets are devastating to the lives of consumers and families. In particular, across-the-board cuts and expansion of family participation fees to all services put in immediate jeopardy the health and safety, well-being, civil rights and freedom of people with developmental disabilities. We cannot, in good conscience, allow any curtailment of these rights. These actions increase the isolation and stigmatizing of people with disabilities within their communities.
The Arc of California resolves that our mission and purpose requires us to commit our full energy and efforts to assure that we:
1. Provide unequivocal support of the entitlement for people with developmental disabilities as established by the California Supreme Court, defend their rights established in the Lanterman Act, and the integrity of the IPP process
2. Oppose any threats to individualized services and supports for people with developmental disabilities and their families. These threats include:
- reductions in regional center Purchase of Service an Operations budgets,
- reductions in IHSS,
- reductions in Medi-Cal,
- reductions in SSI/SSP,
- The imposition of new or expanded fees on families,
- The continuation and addition of new freezes or reductions in rates paid to service providers,
- The denial of due process rights,
- The establishment of waiting lists for Healthy Families,
- Reductions in education impacting students with disabilities
- The continuation of limitations on eligibility for services in the developmental disabilities system.
The Arc of California resolves to act consistent with these principles so as to preserve the integrity of the system of services to individuals with developmental disabilities and their families.

This
Resolution is the work of families joined together through

with developmental disability and their families, standing
united and dedicated to serving and protecting the rights of
children and adults with developmental disabilities in the
State of California
The Board of Directors of The
Arc of California views its responsibilities and
commitments to individuals with developmental disabilities
and their families as a sacred covenant and as the primary
purpose of the organization. We recognize that the needs of
people do not change based on a reduction in financial
resources. As a Board we are dedicated to honoring our
purpose, even in the face of the current fiscal crisis.
The Arc of California Board
feels strongly that the Budget and Trailer Bill language
that has been submitted by the Administration to accompany
the proposed 2003-04 State Budget is devastating to
individuals with developmental disabilities and their
families. The Budget Trailer Bill language jeopardizes the
safety, well-being, civil rights and freedom of people with
developmental disabilities. We cannot, in good conscience,
allow any curtailment of the civil rights, or services as
defined by the Individual Program Plan (IPP) for each person
and family we serve. Therefore, The Arc of California Board
is vehemently opposed to the Trailer Bill language because
it destroys key protections of the Lanterman Act and the
fundamental rights, including the right to services,
mandated by each person’s IPP.
The Arc of California Board
resolves that our mission and purpose requires us to commit
our full energy and efforts to assure that we:
1) Provide unequivocal
support of the entitlement for people with developmental
disabilities as established by the California Supreme Court,
and defend their rights established in the Lanterman Act;
2) Oppose any threats to
individualized services and supports for people with
developmental disabilities and their families, including the
imposition of new or expanded fees on families, denial of
due process rights, or the limitation of eligibility as it
is currently defined in the Lanterman Act;
Further, The Arc of California
Board resolves to act consistent with these principles so as
to preserve the integrity of our stated mission and purpose.

The
Arc of California recognizes California’s need to access
federal participation funds through the waiver process.
The Arc of California will support waiver language that
reflects the following underlying principles:
1.
A Waiver shall not reduce or constrain an
individual’s right to services protected under the
Lanterman Act.
2.
A Waiver shall promote individual/family control
of resources that fully embodies the principle of
self-determination and not be used solely or primarily
as a cost containment measure.
3.
A Waiver shall allow families and individuals to
access a full array of services and supports through the
IPP process.
4.
A Waiver shall not create another layer (or
duplicative layer) of costs.
